Анотація
Досліджено досвід Франції, Великобританії, Грузії, Австрії, Німеччини у застосування поліцейських заходів примусу. Зазначено, що досвід зарубіжних стандартів застосування заходів поліцейського примусу в зарубіжних країнах може бути корисним для України як держави, яка має стратегічний курс на інтеграцію до Європейського Союзу. Але, слід враховувати, що вищенаведене спирається на відповідну законодавчу базу, історію, суспільство. Тому, пріоритетним є створення державного органу виконавчої влади, повноваженнями якого мають бути аналіз ефективності застосування Національною поліцією України заходів поліцейського примусу.
The relevance of the article lies in the fact that today Ukraine continues its strategic course towards full membership of Ukraine in the European Union. The features of the current stage of Ukraine’s integration into the European Union are the creation of the necessary conditions for such membership. One of these conditions is the approach of the National Police of Ukraine in terms of training, management, material support and technical equipment to the standards established for similar formations of the relevant states – members of the European Union. The use of police coercive measures plays a significant role in organizing and strengthening discipline in all spheres of public life. The improvement of the organizational and legal foundations of the police, the lack of scientific research on the specified topic, determine the relevance of research and the search for and introduction of European approaches in the field of the use of coercive measures by the police during the performance of the tasks assigned to them by the state. The article examines the foreign experience of the use of coercive police measures during the performance of official duties. Taking into account the fact that the search and implementation of European approaches in the field of the use of coercive measures by the police during the performance of powers and tasks to ensure public order are relevant today, foreign standards were analyzed. The article studies the experience of France, Great Britain, Georgia, Austria, and Germany. Studying the experience of foreign standards of the application of police coercion measures in foreign countries can be useful for Ukraine as a state that has a strategic course for integration into the European Union. Conclusions have been made. It was concluded that the study of foreign experience of the use of police coercion in foreign countries can be useful for Ukraine. However, it should be taken into account that the above is based on the relevant legislative framework, history, and society. Therefore, the priority is the creation of a state body of executive power whose powers should be to analyze the effectiveness of the use of police coercion measures by the National Police of Ukraine.
