Наголошено, що криміналістична характеристика незаконної порубки
та контрабанди лісу, вчиненої організованою злочинною групою, є науковою категорією, представленою системою узагальнених відомостей про
типові ознаки елементів механізму
вчинення названих протиправних діянь, знання яких дозволяє вірно
визначити напрям і програму розслідування з метою оптимізації кримінального провадження. Структурними елементами криміналістичної
характеристики незаконної порубки
та контрабанди лісу, вчиненої організованою злочинною групою, є обстановка вчинення злочину; способи
та сліди злочину; особа злочинця.
The purpose of the article is to
determine the significance of the
forensic characterization of illegal
logging and smuggling of forests
committed by an organized criminal
group for the development of forensic
science and activities to detect and
prosecute illegal acts; determination
of structural elements of the specified
characteristic taking into account
features of the mechanism of
commission of the named category
of criminal offenses. In the article
has been emphasized that the state pays great attention to the protection
of forests of Ukraine, in particular
by determining the grounds for
criminal prosecution: in Art. 246 of
the Criminal Code of Ukraine defines
the composition of a criminal offense
related to illegal logging or illegal
transportation, storage, sale of forest,
and defines the appropriate types
and measures of punishment, and
in Art. 2011 of the Criminal Code of
Ukraine – moving across the customs
border of Ukraine out of customs
control or withholding from customs
control of timber or lumber of valuable
and rare species of trees, unprocessed
timber and other timber prohibited for
export outside the customs territory
of Ukraine. It has been emphasized
that in order to optimize the activities
for the detection and investigation of
these criminal offenses, it is important
to clarify and distinguish the patterns
of criminal offenses under Art. 2011
and 246 of the Criminal Code of
Ukraine, organized by criminal
groups, by forming the appropriate
forensic characteristics. It has been
emphasized that in the forensic
characterization the interrelation of
theoretical (scientific) and practical
(applied) aspects is clearly traced,
because, being a product of scientific
activity, a theoretical category, the
forensic characterization of criminal
offenses of a particular type plays
a tentative role in determining
directions and means methods of
their investigation. The content of the
forensic characterization of illegal
logging and smuggling of forests
committed by an organized criminal
group has been determined – the
circumstances of the crime; methods
and traces of the crime; the identity
of the offender.
Отмечено, что криминалистическая характеристика незаконной порубки и контрабанды леса, совершенной организованной преступной группой, является научной категорией, представленной системой обобщенных сведений о типичных признаках элементов механизма совершения названных противоправных деяний, знание которых позволяет правильно определить направление и программу расследования с целью оптимизации. Структурными элементами криминалистической характеристики незаконной порубки и контрабанды леса, совершенной организованной преступной группой, есть обстановка совершения преступления; способы и следы преступления; личность преступника.
