Юридичні аспекти залучення авіаційного персоналу до протистояння українських силових структур російській агресії (2014–2022)

Abstract

Відзначено, що авіація стає основним та вирішальним елементом в умовах воєнного стану. Розглянуто проблеми, що виникають у рамках правової регламентації відносин у сфері залучення авіації. Висвітлено нагальну потребу у відповідних реформаторських змінах у системі підготовки та функціонування за призначенням персоналу авіації та шляхи її вирішення. Необхідно розробити перехідну систему підготовки авіаційного персоналу, в тому числі в силових структурах України, яка буде спрямована на підвищення якості професіоналізму авіаційних фахівців в умовах воєнного стану, підготовку спеціалістів нової формації, здатних до продуктивного впровадження перспективних науково-дослідних та дослідно-конструкторських розробок. Підкреслено необхідність запровадження нових вимог до кадрової роботи.

The scientific study is devoted to the consideration of legal aspects of the involvement of aviation personnel in the opposition of Ukrainian security forces to Russian aggression (2014-2022). The relevance of the article is determined by the trends that are connected with the fact that aviation is becoming the main and decisive element in the conditions of martial law. Accordingly, addressing the problems arising within the framework of legal regulation of relations in the sphere of aviation involvement is one of the significant components of the analysis. Today’s society needs highly qualified, competitive and intellectually developed specialists in the field of aviation, capable of maneuvering and quickly adapting to constant changes in working conditions, confidently, skillfully and effectively using human resources in the field of innovative technologies, constantly working on the development of their potential, aimed at ensuring interests of the state, national security and the needs of society. The existing system of aviation personnel training in Ukraine is conservatively burdensome and not competitive at the current stage of solving the urgent tasks of the transition from peacetime to wartime, the solution of which will make it possible to improve the legal regulation of the involvement of aviation personnel of both state and civil aviation, to solve the state tasks of protecting the Motherland. The study highlighted the urgent need for appropriate reformatory changes in the system of training and functioning of aviation personnel and ways to solve it. This is the development of a transitional system of training aviation personnel, including in the force structures of Ukraine, which is aimed at improving the quality of professionalism of aviation specialists in the conditions of martial law, training specialists of a new formation capable of productive implementation of promising research and development developments, introduction of new requirements for personnel work.

Отмечено, что авиация становится главным и решающим элементом в условиях военного положения. Рассмотрены проблемы, возникающие в рамках правовой регламентации отношений в сфере привлечения авиации. Освещена неотложная потребность в соответствующих реформаторских изменениях в системе подготовки и функционирования по назначению персонала авиации и пути ее решения. Необходимо разработать переходную систему подготовки авиационного персонала, в том числе в силовых структурах Украины, которая будет направлена ​​на повышение качества профессионализма авиационных специалистов в условиях военного положения, подготовки специалистов новой формации, способных к продуктивному внедрению перспективных научно-исследовательских и опытно-конструкторских разработок. Подчеркнута необходимость введения новых требований к кадровой работе.
