Анотація
Досліджено сутність понять «обіг лікарських засобів» та «обіг наркотичних засобів», визначено їх правовий режим. На підставі аналізу нормативних актів і спеціальної наукової літератури доведено, що сфери обігу лікарських та наркотичних засобів є об’єктами адміністративно-правового регулювання. Визначено структурні елементи механізмів адміністративноправового регулювання обігу лікарських і наркотичних засобів.
It has been grounded that the appropriate level of health care of Ukraine’s population is largely dependent on the quality and safety of medicines, medical equipment and medical products. It has been separately stressed that the health and genetic pool of the nation require to develop a proper legal provision of the circulation of drugs, psychotropic substances and precursors, as well as combating illicit manufacturing, transportation and usage. The article’s objective is to determine the nature and characteristics of the circulation spheres of medicines and drugs as the objects of administrative and legal regulation. The author of the article has studied the essence of the concepts of “circulation of medicines” and “circulation of drugs”, defined their legal regime. On the basis of regulations and special scientific literature’s analysis it has been proved that the circulation spheres of medicines and drugs is the objects of administrative and legal regulation. It has been established that the administrative and legal regulation – is a branch kind of legal regulation, which is the state’s influence on social relations arising in the sphere of public administration, implemented by the assistance of appropriate legal means, and establishes the rights and obligations of the participants of these legal relations. It has been stated that the main subjects that are members of administrative and legal relations concerning health care of population, circulation of medicines and drugs, are the Cabinet of Ministers of Ukraine, Ministry of Health of Ukraine and State Service of Ukraine on medicines and drugs control, which are determined by regulatory acts. The author has defined the structural elements of the mechanisms of administrative and legal regulation of the circulation of medicines and drugs: 1) administrative and legal norms, that is established by the state generally binding rules of conduct that regulate social relations in the sphere of public administration by the circulation of medicines and drugs, psychotropic substances and precursors; 2) administrative and legal relations arising in regard to the circulation of medicines and drugs, psychotropic substances and precursors; 3) acts of implementing administrative and legal norms that regulate social relations in the sphere of public administration by the circulation of medicines and drugs, psychotropic substances and precursors.
Исследована сущность понятий «оборот лекарственных средств» и «оборот наркотических средств», определён их правовой режим. На основании анализа нормативных актов и специальной научной литературы доказано, что сферы обращения лекарственных и наркотических средств являются объектами административно-правового регулирования. Определены структурные элементы механизмов административно-правового регулирования обращения лекарственных и наркотических средств.
