Досліджено можливість відшкодування (компенсації) моральної (немайнової) шкоди фізичній особі, яка потерпіла від кримінального правопорушення, за
рахунок державного бюджету України. Сформульовано визначення поняття «моральна (немайнова) шкода, що завдана фізичній особі кримінальним правопорушенням». Проаналізовано зміст моральної (немайнової) шкоди й умови її відшкодування.
The author has researched possibilities of reimbursement (compensation) of
moral (non-property) harm to an individual who has suffered from a criminal offense, at
the expense by the state budget of Ukraine. The content and legal nature of the concept
“moral (non-property) harm caused to an individual by a criminal offense” have been
formulated. It has been argued that there is no unambiguous understanding of the issue
on the essence of the notion of moral harm. The content of moral (non-property) harm
and the conditions for its compensation have been analyzed. The definition of the notion
of moral (non-property) harm as a result of unfavorable consequences caused to an
individual by a crime has been revealed. It has been concluded that the duty of the state
to compensate for the damage caused by a crime provided by the Art. 1177 of the Civil
Code of Ukraine is not due to its actions and without guilt. The grounds and conditions
for reimbursement of the harm by the state caused by a crime have been characterized.
Specific conditions for compensation for damage by the state caused by a crime have
been indicated.
Theoretical conclusions on the studied issues and practical propositions aimed
at improving the institution of reimbursement of the damage by the state inflicted by the
crime have been formulated.
Исследованы возможности возмещения (компенсации) морального (неимущественного) вреда физическому лицу, пострадавшему от уголовного преступления, за счет государственного бюджета Украины. Сформулировано определение понятия «моральный (неимущественный) вред, причиненный физическому лицу уголовным правонарушением». Проанализировано содержание морального (неимущественного) вреда и условия его возмещения.
