Використання результатів одорологічного дослідження як доказів у кримінальному провадженні

Abstract

На підставі аналізу слідчої практики та наукової літератури виявлено основні проблеми використання одорологічних досліджень у кримінальному провадженні та запропоновано шляхи їх вирішення.

On the basis of the analysis of the practice of pre-trial investigation and scientific literature the author has offered detailing of the main provisions of using odorology method ofresearch of scent traces. It is stated that a scent trace of a man is a complex of scents, which includes: local smells (body parts), individual smell (the entire amount of local smells), the overall smell (scent in clothing, including professional smell and by-smelling perfume, tobacco, etc.). This composition of scent trace provides individuality. Thus, solution of the problems of using the results of the examination of odorous substances and scent traces in the process of proving is out of legislative sphere, but belongs to the scientific field. It is obvious that nowadays there is a need of practical work to expand and development of conducting odorology examinations while the investigation of various crimes. It should involve not only the dog handlers, but also experts in the field of biology, chemistry, medicine, etc., who have certain knowledge about the mechanism and regularity of formation of scent traces and can offer modern scientific methods of examination. It is concluded that the judicial odorology is a promising direction in the system of solving and investigating crimes, it helps to reveal persons, who have committed them. That’s why the results of odorology examination should not be of secondary importance relative to other types of expert research. Today the full use of scent traces in criminal proceedings is only possible in terms if the judicial odorology gets the official consolidation in practice; if the detailed regulation of the methods of odorology examination is formed; if the results of odorology examinations would be used as valuable evidence in criminal proceedings.

На основе анализа следственной практики и научной литературы выявлены основные проблемы использования одорологических исследований в уголовном производстве и предложены пути их решения.
