Анотація
Проаналізовано нормативно-правові аспекти діяльності Фонду гарантування вкладів фізичних
осіб щодо відшкодування банківських вкладів у разі неможливості банків виконати свої зобов’язання. На підставі порівняльно-правового аналізу виділено основні особливості та проблемні аспекти захисту прав і законних інтересів вкладників банків, а також запропоновано
зміни до чинного законодавства, яке регулює функціонування системи гарантування вкладів
фізичних осіб.
The author has analyzed the normative and legal aspects of the activities of the Deposit Guarantee Fund (hereinafter – Fund, DGF), which was established in 1998 in accordance with the Edict of the President of Ukraine «On measures to protect the rights of individuals – depositors of commercial banks in Ukraine» dated from September 10, 1998 No. 996/98 in order to reimburse bank deposits in case banks fail to fulfill their obligations. The article’s objective is to study the regulatory and legal principles of the activities of the DGF and to improve the legal aspects of the bank deposits reimbursement in case banks fail to fulfill their obligations. Based on comparative and legal analysis of certain provisions of the current regulations the author has found out inconsistencies in the regulation of calculating the accrual basis of regular exclusive to the DGF and procedures for reimbursement of certain categories ofretail deposits. The author has put forward the issue about legal solution of the problem of the length of the period between the date when individuals face the problems of returning his own deposit and the moment of the deposit’s reimbursement by the Fund, as well as the issue of reimbursement of rate differences that may arise during this period. Solution of these issues requires further improvement of the normative and legal base regulating the functioning ofthe system of deposit guarantee fund in Ukraine. Special attention is paid to the issue of priority and terms of deposits reimbursement of individuals who are not related parties of the bank (in excess of 200 000 UAH), and the funds placed on a deposit by the related person with the bank. To protect the rights and legitimate interests of these categories ofdepositors it is suggested to improve provisions ofthe current legislation. The practical significance of the suggested changes is the ability to solve problems of inconsistencies between certain existing provisions of the current regulations, to make transparent the modern mechanism of deposit guarantee funds and to increase significantly the protection of the rights and legitimate interests ofinvestors, and thus to increase the trust for the banking sector in the whole.

На основании сравнительно-правового анализа выделены основные особенности и проблемные аспекты защиты прав и законных интересов вкладчиков банков, а также предложены изменения в действующее законодательство, регулирующее функционирование системы гарантирования вкладов физических лиц.
