Анотація
Розглянуто питання співвідношення категорій «заробітна плата» та «оплата праці». Проаналізовано сучасний стан юридичної термінології у сфері оплати праці. Досліджено підходи науковців до визначення поняття «заробітна плата». Надано авторське визначення поняття «заробітна плата». Запропоновано рекомендації з удосконалення національного законодавства у сфері оплати праці.
The current state of legal terminology in the wages sphere is analyzed. It is noted that there are various categories of «compensation», «wages», «remuneration for work» for determining the same phenomena, which are used in the Art. 43 of the Constitution of Ukraine and the Art. 2 of the Labor Code of Ukraine. Analysis of other national normative and legal acts allows to outline a number of other terms in this field («money guaranteeing», «salaries», «material guaranteeing»). Impossibility to use synonyms in the texts of normative and legal acts is proved. This situation violates the unity of legal terminology and can lead to errors in enforcement and jurisprudence. Approaches of scientists and Ukrainian and Russian legislators on defining the notion «wages» are researched. The expediency of defining the notion «wages» through the form of paying wages as well as such feature as regularity of its payment is grounded. The latter goes out of the Art. 12 of the Convention of Wages Protection No. 95 and the Art. 24 of the Law of Ukraine «On Compensation». Thus, in accordance with the Art. 12 of the Convention of Wages Protection No. 95, wages will be paid in regular intervals. Author’s definition of the notion «wages» as a cash payment, which is usually carried out by an employer at regular intervals to an employee for fulfilled work, provided by the labor contract, is presented. Recommendations to improve national legislation on wages are offered.
Рассмотрены вопросы соотношения категорий "заработная плата" и "оплата труда". Проанализировано современное состояние юридической терминологии в сфере оплаты труда. Исследованы подходы ученых к определению понятия «заработная плата». Дано авторское определение понятия «заработная плата».
