dc.description.abstractOn the basis of the analysis of the current Criminal procedural Code of Ukraine, the practice of implementing some measures of criminal and legal nature as well as doctrinal points of view the author formulates generalized conclusions about the place of criminal and legal qualification in the process of implementing measures of criminal and legal nature. In particular, it is noted that criminal and legal qualification is a part of the process of legal enforce - ment. In other words, the process of implementing the law norm is not exhaust- ed with criminal and legal qualification. In this regard, the author stresses that any measure of criminal and legal nature finds its form in various norms of the General Part of the Criminal Code of Ukraine, in particular, norms that declare penalties, types of compulsory measures of educational and medical nature, as well as types of measures of criminal and legal nature concerning legal entities; the norms regulating the individualization of punishment, individualization of compulsory medical measures and measures of criminal and legal nature con - cerning legal entities; norms regulating the exemption from punishment and serving it; norms regulating the exemption from criminal liability or the gener- al exclusion of such liability, etc. Since the law norm with all its components is a form of expressing any measure of criminal and legal nature, it is noted that the problem of determining the place of criminal and legal qualification in the process of implanting the measures of criminal and legal nature is obvious. The author draws attention to the fact that socially dangerous (illegal) or socially useful (lawful) conduct of an individual and socially dangerous (illegal) behavior of an individual, carried out for the benefit or on behalf of a legal enti- ty may be the subject of criminal and legal qualification. Thus, it is stated that criminal and legal qualification – is an activity re - lated to the assessment and legal fixing of the compliance of the features of committed socially dangerous act with the features of criminal assault provided by the hypothesis of the General Part or the norm’s disposition of the Special Part of the Criminal Code of Ukraine, or with the features of non-criminal action under the norm’s hypothesis of the General Part of the Criminal Code of Ukraine. It is also noted that in the process of implementing most of measures of criminal and legal nature the qualification finds its place both at the stage of selection and analysis of a legal norm (preliminary qualification) and at the stage of solv- ing the case (final qualification). Exceptions are cases of qualification of socially dangerous acts of insanes and socially dangerous acts of persons who have not attained the age of criminal liability; in these cases, the qualification of socially dangerous acts finds its place on the stage of selection and analysis of a legal norm. However, considering the fact that criminal and legal qualification is not limited by qualification of offenses, it is offered to state the results of qualifica - tion of acts that are not crimes in the operative part of judgments in specific cases.en
