Foreign experience of legal regulation of non-discrimination on gender grounds in the world of labor: overview and possibilities of its implementation in Ukraine

Анотація
Виділено позитивний зарубіжний досвід правового регулювання недопущення дискримінації у сфері
праці за ознакою статі та визначено можливості впровадження такого досвіду в Україні. Запропоновано
низку законодавчих змін, які є необхідними для їх врахування під час реформування трудового законодавства задля утвердження та зміцнення загальнолюдських цінностей, гармонізації правового регулювання суспільних відносин, зміцнення непорушності прав та інтересів чоловіків та жінок у сфері праці.
Наголошено на важливості подальшого врахування та запозичення прогресивного зарубіжного досвіду при вирішенні на теренах України будь-яких проблемних питань, що пов’язані із правовим регулюванням недопущення дискримінації у сфері праці за ознакою статі.
The paper provides a comprehensive review of foreign experience in legal regulation in order to prevent gender-based discrimination in the world of work. It has been established that the legislation of foreign countries aimed at solving the problem of avoidable gender-based discrimination in the world of work, convincingly testifies to the existence of legislative provisions, sufficient in their scope, regulating solutions to various aspects of this problem. It was found that the labor codes of foreign countries are not exclusively the only regulatory framework that should be taken into account when referring to the review of foreign experience in solving the problem of gender discrimination in the world of work. Given the foregoing, attention is paid to a meaningful analysis of normative legal acts that are directly aimed at achieving a parity position of women and men in the world of work by legal ensuring equal rights and opportunities, protecting men and women from gender-based discrimination, eliminating the imbalance between the opportunities for women and men to exercise equal rights. The positive foreign experience of legal regulation of non-discrimination on gender grounds in the world of work has been highlighted and the possibilities of introducing such experience in Ukraine have been identified. A number of legislative changes have been proposed that are necessary to take them into account when reforming labor legislation to approve and to strengthen universal human values, to harmonize the legal regulation of labor and relations closely related to them, to strengthen the inviolability of the rights and interests of men and women in the world of work. The importance of further integrating and borrowing progressive foreign experience in solving any problematic issues in the territory of Ukraine related to the legal regulation of non-discrimination on gender grounds in the world of work has been emphasized.
Выделен положительный зарубежный опыт правового регулирования недопущения дискриминации в сфере труда по признаку пола и определены возможности внедрения такого опыта в Украине. Предложен ряд законодательных изменений, необходимых для их учета при реформировании трудового законодательства для утверждения и укрепления общечеловеческих ценностей, гармонизации правового регулирования общественных отношений, укрепления нерушимости прав и интересов мужчин и женщин в сфере труда. Отмечено важность дальнейшего учета и заимствования прогрессивного зарубежного опыта при решении в Украине любых проблемных вопросов, связанных с правовым регулированием недопущения дискриминации в сфере труда по признаку пола.
