Анотація
Вивчено позитивний досвід здійснення правового регулювання в різних європейських країнах із розвинутою ринковою економікою найбільш принципових питань відпусток. Відзначено основні тенденції міжнародно-правового регулювання в цій сфері.
Analysis of the content of international norms about vacation that are specified in the Conventions of the International Labor Organization and acts of the European Union allowed to note two basic tendencies of international and legal regulations in this area. The essence of the first is in the constant raising the level of guarantees of realizing the rights of employees on vacation. The second tendency is connected to the shift from establishing mainly the mandatory rules to dispositive. Collectively-contractual practices of the countries with the developed economy significantly increases the level of guarantees for employees in comparison to the requirements contained in the Convention, and for many countries (especially developing countries) is a benchmark for further progress in the legal regulation of vacations, indicating the perspective tasks for the future. The feature of the legislation of some European countries is the fact that it provides standards that promote business development through the provision of additional vacation. On this basis, it would be appropriate to implement incentive holidays into the legislation of Ukraine. European experience in regulating vacation is extremely useful for Ukraine and should be used while adopting a new Labor Code of Ukraine
Изучен позитивный опыт осуществления правового регулирования в разных европейских странах с развитой рыночной экономикой наиболее принципиальных вопросов отпусков. Отмечены основные тенденции международно-правового регулирования в этой сфере.
