Реформування національного законодавства у сфері проходження служби в органах внутрішніх справ – нагальна вимога сьогодення

Abstract

Розглянуто проблеми, пов’язані з реформуванням національного законодавства у сфері проходження служби в органах внутрішніх справ. Проаналізовано основні нормативно-правові акти, які регламентують проходження служби в поліції. Виявлено їх слабкі місця. Надано науково обґрунтовані рекомендації з удосконалення національного законодавства у цій сфері та практики його застосування.

The problems related to the reform of the national legislation in the field of service within internal affairs agencies have been considered. The basic regulations governing the service in the police have been analyzed; their weaknesses have been revealed. Scientifically based recommendations for improving the national legislation in this field and the practice of its implementation have been provided. It was noted that reforming of the Ministry of Internal Affairs of Ukraine had to happen in this way. First, it was necessary to agree the structure of the Ministry of Internal Affairs of Ukraine both in the Cabinet of Ministers of Ukraine and in Verkhovna Rada of Ukraine and to find consensus on this issue. Considering scientifically grounded approach to determine the number of staff of each agency, which will be a part of an appropriate structure. To adopt, first, the Law of Ukraine «On Internal Affairs Agencies», and then, if needed, to adopt some laws concerning different agencies that are included in the structure of internal affairs agencies, including the National Police. Parallel to this, it was necessary to carry out quickly the cleaning process of the system of internal affairs agencies from corrupt officials and other persons specified in the Law of Ukraine «On Cleaning the Power» dated from September 16, 2014 No. 1682-VII. To do this it would be appropriate to conduct certification of rank and files and officers of internal affairs agencies, during which to provide principled assessment of each of them.

Рассмотрены проблемы, связанные с реформированием национального законодательства в сфере прохождения службы в органах внутренних дел. Проанализированы основные нормативно-правовые акты, регламентирующие прохождение службы в полиции. Выявлены их слабые места. Предоставлены научно обоснованные рекомендации по усовершенствованию национального законодательства в этой сфере и практики его применения.
