Анотація
Розглянуто основні тенденції розвитку окремих методик розслідування злочинів, пов’язані з реформуванням
кримінального процесу України. Підкреслено необхідність перегляду деяких теоретичних положень криміналістичної методики у зв’язку з трансформацією
законодавства, слідчої та судової практики. Наголошено на неприпустимості необґрунтованої критики наукових пошуків у галузі криміналістики. Запропоноване
власне бачення напрямів удосконалення класифікації
окремих криміналістичних методик, їх структури та
змісту, формування комплексних методик розслідування, а також надані рекомендації щодо судового розгляду кримінальних справ.
The article describes the basic tendencies of the development of particular methods of investigation of crimes related to the reform of criminal justice in Ukraine. It is underlined on the need to review some of theoretical positions of criminalistic methods in connection with the transformation of laws, investigative and judicial practice. At the same time it is marked that the inadmissibility of unjustified criticism of scientific research in the field of criminalistics laid the foundation for using the term «criminal offense» in relation to the consideration of the problems of criminalistic methods. The author suggests his own opinion about the ways of improving the classification of particular criminalistic methods depending on the attitude to the criminal law. In this regard, it is offered to consider inter-species, species, subspecies and complex investigation techniques. The author has marked a need for an all-round approach to the structure of the particular methods of investigation of crimes. In particular, the common methods are characterized by variability of the structure, and special must be built according to a single scheme: criminalistic characteristics of crime, the initiation of criminal proceedings, the initial stage of the investigation, the subsequent stage of the investigation, special aspects of the methods of particular investigative actions and undisclosed investigative (search) actions. The author has underlined on the perspective of the development of complex methods of investigation, in particular, multiple economic crimes. It is indicated the difficulties in the differentiation of stages of the investigation depending on procedural solutions of an investigator in connection with the particular problems of the initiation of criminal procedure. The author suggests to intensify the work on the inoculation the recommendations on the specifics of investigative tactics of undisclosed investigative (search) actions into particular criminalistic methods for certain categories of crimes. It is noted as a debatable issue of the desirability of development of particular criminalistic methods of a trial of criminal cases along with traditional methods of pre-trial investigation. It is offered to develop appropriate recommendations concerning this issue only with regard to broad types or groups of crimes.
Рассмотрены основные тенденции развития частных методик расследования преступлений, связанные с реформированием уголовного процесса Украины. Подчёркнута необходимость пересмотра некоторых теоретических положений криминалистический методики в связи с трансформацией законодательства, следственной и судебной практики. Отмечена недопустимость необоснованной критики научных поисков в области криминалистики. Предложено собственное видение направлений усовершенствования классификации частных криминалистических методик, их структуры и содержания, формирования комплексных методик расследования, а также рекомендаций относительно судебного рассмотерния уголовных дел.
